These Terms of Service ("Terms") govern your access to and use of supplementor.org (the "Website") and the tutoring services provided by Supplementor LLC ("Supplementor," "we," "our," or "us"). By using the Website or enrolling a student, you agree to these Terms. If you do not agree, please do not use the Website or enroll.
1. Service Scope
Supplementor provides private K-12 academic tutoring and standardized test-preparation services to students residing primarily in the greater Austin, Texas metropolitan area. Tutoring is offered in three formats: one-on-one in-home sessions within a 25-mile radius of our Manor Rd. learning center, one-on-one online sessions delivered via our shared digital whiteboard platform, and small-group cohorts of two to four students hosted at our Austin learning center.
Supplementor is an academic tutoring service. We are not a school, do not issue grades or transcripts, and do not replace mandatory K-12 schooling required by Texas state law.
2. Enrollment and Eligibility
Tutoring services may only be enrolled by a parent or legal guardian of the student. The enrolling adult represents that they are at least 18 years of age, have legal authority over the student's educational decisions, and accept financial responsibility for tutoring fees.
3. Tutor-Student Conduct
All Supplementor tutors hold current Texas Department of Public Safety background checks and complete internal child-safety training. Tutors are required to maintain professional, age-appropriate conduct at all times. For in-home sessions, a parent, guardian, or authorized adult must be present in the home for the duration of any session involving a student under 16.
4. Scheduling and Cancellation
Sessions are scheduled in advance through our family portal or by direct communication with the assigned tutor. Cancellation policies:
- More than 24 hours before a session: free cancellation, full credit applied to next session.
- Within 24 hours but more than 4 hours: half-session credit applied.
- Within 4 hours of session start: full session fee billed (tutor has been blocked off for that time).
- Tutor-cancellations: full credit applied with priority rescheduling within 7 days.
Either party may end the tutoring relationship at any time with 48 hours notice. Any unused prepaid sessions will be refunded pro-rated to the most recent two-week billing cycle.
5. Fees and Payment
Tutoring fees are quoted at enrollment based on format, grade level, and frequency. Standard sessions are billed in two-week cycles in advance. Bootcamp programs are billed as a single package fee. Payment is accepted by credit card, debit card, or ACH. We do not accept cash for student safety reasons. Past-due balances over 14 days will pause active tutoring until resolved.
6. Refund Policy
Free 30-minute initial consultations are non-refundable because they are free. Placement Check sessions are non-refundable once delivered. Two-week cycle prepayments are refunded pro-rata for any unused sessions when service ends. Bootcamp packages are refundable on a sliding scale: 100% before the first session, 50% within the first two weeks, no refund after week three.
7. Intellectual Property
All content on supplementor.org — including text, graphics, logos, photographs, instructional materials, lesson plans, practice tests, and proprietary placement-check frameworks — is the exclusive property of Supplementor LLC or its licensors and is protected by United States copyright and trademark law. Families enrolled in our programs receive a non-transferable, non-exclusive license to use Supplementor instructional materials solely for their own student's education during the period of active enrollment. Reproduction, redistribution, public posting, or commercial reuse of Supplementor materials is strictly prohibited.
8. User Obligations
Parents and students agree to:
- Provide accurate enrollment information
- Treat tutors with courtesy and professional respect
- Maintain a safe, drug-and-alcohol-free environment for in-home sessions
- Not record audio or video of sessions without prior written consent from Supplementor
- Not solicit Supplementor tutors for private engagement outside the Supplementor relationship for the duration of enrollment plus 12 months
9. Limitation of Liability
To the maximum extent permitted by Texas law, Supplementor LLC's total liability arising from or related to these Terms or any tutoring service shall not exceed the total fees paid by the family to Supplementor in the twelve months preceding the claim. Supplementor shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost academic opportunities, lost test-score outcomes, or lost admissions outcomes. Tutoring is an educational service. We work hard, but academic outcomes depend on many factors beyond our control.
10. No Guarantee of Outcomes
Supplementor does not guarantee any specific grade, test score, admission decision, or academic outcome. Statistics published on supplementor.org (such as "average 218-point SAT lift") reflect historical averages across our student population and are not predictive of individual results.
11. Indemnification
You agree to indemnify and hold harmless Supplementor LLC, its officers, employees, and tutors from any claim, demand, or damage arising out of your breach of these Terms or your misuse of Supplementor services.
12. Dispute Resolution and Governing Law
These Terms are governed by the laws of the State of Texas without regard to conflict-of-law principles. Any dispute arising from these Terms or the use of Supplementor services shall be resolved exclusively in the state or federal courts located in Travis County, Texas. The parties waive any right to a jury trial. Before filing suit, the parties agree to attempt resolution in good faith via written notice and a 30-day cure period.
13. Modification of Terms
Supplementor may modify these Terms at any time. Material changes affecting enrolled families will be communicated by email at least 30 days before they take effect. Continued use of the Website or services after the effective date constitutes acceptance of the revised Terms.
14. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy and any signed enrollment agreement, constitute the entire agreement between you and Supplementor regarding the Website and our tutoring services.
